Terms & Conditions

These Terms of Use (“Terms”) govern your use of the websites provided by Sun Hung Kai Properties and participating SHKP malls (or referred to as “us”). Please read these Terms carefully. By accessing and using the Platforms, you agree that you have read, understood and accepted the Terms including any additional terms and conditions and any policies referenced herein, available on the Platforms or available by hyperlink.

  1. All users must reached 18 years of age. Users below the age of 18 must obtain consent from parent(s) or legal guardian(s), who by accepting these Terms shall agree to take responsibility for your actions and any charges associated with your use of the Platforms and/or purchase of Goods.
  2. To use the Web Site, you will need to provide your personal information including a valid name, email address, a mobile phone number and a payment method details. To purchase an Order, depending on which payment method you opt for, you may need to provide us with your credit card details. Save for cases of fraud or abuse which are not your fault, you accept that all Orders placed under you are your sole responsibility.
  3. Sun Hung Kai Properties, the participating malls and the participating merchants will not bear any responsibility in any case of network problems, system malfunctioning, poor phone reception, blocking by third party applications, incomplete/ inaccurate/ missing information provided by customers that cause the delay, loss, mistake or corruption of an information transfer, which caused failure of completion of order/transaction, failure of delivery of confirmation email and respective QR code for pick-up verification or other issues of order/transaction.  Users/ customers are obliged to provide information that is complete, accurate and truthful for the proper processing of the Order, including your contact and payment information. 
  4. Users can only order goods (including but not limited to food and beverage, merchant voucher and product)(the Goods) from the same merchant at the same mall in each single transaction with this web site. No combination can be made for orders from different merchants or different malls.
  5. To complete an Order, please follow the onscreen instructions after clicking Confirm’. Users/ customers may be required to provide additional details to complete the Order. Users/ customers are required to review and confirm that all the information provide, including the amounts, pick-up details, personal details, payment information, and promotion codes (if applicable) is true, accurate and complete before you click “Confirm”. 
  6. Prices quoted on the Web Site shall be displayed in the Hong Kong Dollar. Prices and offers on the Web Site may vary. A breakdown of the prices, discount or promotion offer and additional charges are displayed before Checkout. Confirmation of order information and payment means users/customers accept all amounts, additional charges and the final ‘Total’ amount which is displayed upon order placement. 
  7. Users/ customers should enter and use the promotion code to enjoy the discount or offer before confirm the order. Except specified, no retrospective arrangement can be made.
  8. Once the Order confirmed, no modification, cancellation, refund, exchange, exchange for cash shall be made and it’s not transferable. 
  9. Limited quota applies on all the Goods supplies, while stock lasts.
  10. All orders placed in this web site must be paid in advance through the system payment gateway. No other payment method will be accepted. Cash or credit card payment made upon collection at pick-up location will not be accepted.
  11. All purchase and transaction in this web site is not eligible for any promotion, rewards, redemption activities of malls, including bonus point registration of The Point by SHKP, gift and free parking order redemption.
  12. Visa, Mastercard, Alipay & Alipayhk and WeChat Pay & WeChat Pay HK are accepted for payment in the Web Site. The Web Site reserves the right to offer additional payment methods and/or remove existing payment methods at anytime in its sole discretion. All payment shall be processed by third party payment service provider(s). Users/ customers agree that respective credit card / payment information will be stored with third party payment service provider(s) upon confirmation of order information and payment. 
  13. Users/ customers must ensure that sufficient fund on credit card or any related wallet to fulfil payment of an Order. Sun Hung Kai Properties, the participating malls and the participating merchants/suppliers will not bear any responsibility in any case of failure of order placement caused by insufficient fund. 
  14. Should users/ customers still decide to cancel the Order after it has been accepted by the merchant/ supplier, you understand that no refunds (whether in whole or in part) will be issued and no Goods in the cancelled Order will be tendered to the users / customers. 
  15. Orders will be cancelled upon rejection by the Merchant/Supplier or not accepted by the Merchant/Supplier within 10 mins after the order placed. The payment of the cancelled order will be refunded to the account paid for this order within 4 working day, or none of this transaction will be shown in the statement as no debit ever made. The lead-time for refund varies from different card and payment organizations, please check with the respective organization directly. 
  16. Merchants/ suppliers may reject the Order accordingly to their operation conditions and refund will be made accordingly. However, no liabilities or compensation shall be made for any issues, loss, charges incurred due to rejection of the Order.
  17. An email notification will be sent to the email address provided upon payment successfully settled and the order request will be also sent to the Merchants/Suppliers. You will receive a confirmation email upon Merchants/Suppliers’ acceptance of your order request, which a QR code will be attached in the email and please present this QR code according at the specified pick-up time and location. In case that the Order is rejected by the Merchants/Suppliers, users/ customers will receive an email for cancellation. Please contact the Merchants/Suppliers directly for order enquiries. In case you have not received any notification email within 10 minutes after order placed, please check the “Junk” or “Spam” mailbox in the email account or contact the Merchants/Suppliers directly. 
  18. A confirmation email will be sent to email address provided upon order confirmation. A QR code for pick-up will be enclosed in the confirmation email. Customers should provide and access the valid email account and internet to get and present the QR code for collection at the designated pick-up location.
  19. An unique QR code will be sent for each transaction and can be used once for the Goods collection. QR code will be void upon collection of the Goods. Please keep this QR code in safe and do not share with others. Invalid/ void QR code will not be accepted. No replacement, exchange or refunded will be made for invalid / void QR code.
  20. Users/ customers are responsible for inspecting the Goods/Order when Pick-Up and shall report any issues and/or defects to the Merchants/Suppliers before leaving the premises of pick-up location.
  21. All Goods are non-refundable, non-transferrable, not for sale, non-exchangeable for cash, cash coupon, gift certificate, coupon, products or services.
  22. From time to time, the Web Site, participating SHKP malls, the Merchants/Suppliers may run marketing and promotional campaigns which offer promotion codes, discounts, and other promotional offers to be used on the Web Site. These offers are subject to validity periods, redemption periods, and in certain cases, may only be used once.
  23. Offers may not be valid when used in conjunction with other promotions, discounts or other vouchers. Additional terms and conditions may apply to Offers. Unless otherwise stated, Offers can only be used on this Web Site. Offers cannot be exchanged for cash or for sale as well.
  24. The Web Site, participating SHKP malls and the Merchants/Suppliers reserve the right to void, discontinue or reject the use of any promotion offer without prior notice.
  25. The right of pick-up or usage of the Goods, services or offer will be become invalid upon suspension or termination of operation of the merchants/suppliers.
  26. While the participating SHKP malls and the Merchants/Suppliers makes reasonable efforts to ensure the provision of the Web Site are updated, but do not warrant or represent that the Web Site shall be provided in a manner which is secure, timely, uninterrupted, error-free, free of technical difficulties, defects or viruses. Users/ customers acknowledge and agree that use of or reliance upon the Web Site and any content, goods, products or services accessed or obtained thereby is at sole risk and discretion. 
  27. Please expect temporary interruptions and suspension of the Web Site due to scheduled or regular/ ad hoc system maintenance work, downtimes attributable to internet or electronic communications or events of force majeure.
  28. To the extent permitted by law, the Web Site, participating SHKP malls and the merchants/Suppliers (which shall include its employees, directors, agents, representatives, affiliates and parent company) exclude all liability (whether arising in contract, in negligence or otherwise) for loss or damage which you or any third party may incur in connection with the Web SIte, services, and any website linked to the Web Site and any content or material posted on it. Your exclusive remedy with respect to your use of the Web Site is to discontinue your use of the Platforms. the Web Site, participating SHKP malls and the merchants/Suppliers entities, their agents, representatives, and service providers shall not be liable for any indirect, special, incidental, consequential, or exemplary damages arising from your use of the Web Site or for any other claim related in any way to your use of the Web Site. These exclusions for indirect, special, consequential, and exemplary damages include, without limitation, damages for lost profits, lost data, loss of goodwill, work stoppage, work stoppage, computer failure, or malfunction, or any other commercial damages or losses, even if the the Web Site, participating SHKP malls and the merchants/Suppliers entities, their agents, representatives, and service providers have been advised of the possibility thereof and regardless of the legal or equitable theory upon which the claim is based. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, the Web Site, participating SHKP malls and the merchants/Suppliers entities, its agents, representatives and service providers' liability shall be limited to the extent permitted by law.
  29. The Web Site, participating SHKP malls and the merchants/Suppliers shall neither be liable for actions or omissions of the Merchants/Suppliers nor users/ customers in regard to provision of the Goods and where Merchants/Suppliers Delivery applies to your Order. the Web Site and participating SHKP malls do not assume any liability for the quantity, quality, condition or other representations of the Goods and/or services provided by the Merchants/Suppliers or guarantee the accuracy or completeness of the information (including menu information, photos and images of the Goods) displayed on the Merchants/Suppliers’ listing/offering on the Web Site. Nothing in these Terms shall exclude the Merchants/Suppliers’ liability for death or personal injury arising from Vendor’s gross negligence or willful misconduct.
  30. Sun Hung Kai Properties and the participating malls shall not be responsible for any obligations and liabilities in relation to the products or services provided by the respective product or service provider(s). 
  31. The Web Site, the participating malls and the Merchants/Suppliers reserve the right to cancel any Order and/or suspend, deactivate or terminate any users / customers use in its sole discretion if it reasonably suspects or detects fraudulent behavior or activity associated with the Order. 
  32. Sun Hung Kai Properties and the participating malls will not bear any responsibility in any case of network problems, system malfunctioning, poor phone reception or blocking by third party applications that cause the delay, loss, mistake or corruption of an information transfer.
  33. Sun Hung Kai Properties, the participating malls and the participating merchants will not bear any responsibility in any case of network problems, system malfunctioning, poor phone reception, blocking by third party applications, incomplete/ inaccurate/ missing information provided by customers that cause the delay, loss, mistake or corruption of an information transfer, which caused failure of completion of order/transaction, failure of delivery of confirmation email and respective QR code for pick-up verification or other issues of order/transaction.
  34. All Orders and transactions are also subject to the terms and conditions of merchants/suppliers.
  35. All photos and description on this Web Site are for reference only.
  36. Pick-up shall be rescheduled or rearranged upon Tropical Cyclone Warning Signal No.8 or above or Black Rainstorm Warning hoisted, while the pick-up deadline and the expiry of the Goods will be remain unchanged.
  37. Sun Hung Kai Properties and the participating malls shall not be responsible for any obligations and liabilities in relation to the products or services provided by the respective product or service provider(s).
  38. Users/ customers agree and consent to the Web Site, participating SHKP malls and the merchants/Suppliers and any of its affiliate companies collecting, using, processing and disclosing the Personal Data in accordance with these Terms and as further described in our Privacy Policy. The Privacy Policy is available via the links on the Web Site, and shall form a part of these Terms.  
  39. Users/ customers agree to indemnify, defend, hold harmless the Web Site, participating SHKP malls and the merchants/Suppliers, its directors, officers, employees, representatives, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including but not limited to, legal fees) arising from the use of the Web Site or breach of these Terms.  
  40. The Web Site may contain links to other third party websites and by clicking on these links, users/ customers agree to do so at their own risk. The Web Site, participating SHKP malls and the merchants/Suppliers do not control or endorse these third party websites or links and shall not be responsible for the content of these linked pages. The Web Site, participating SHKP malls and the merchants/suppliers accept no liability or responsibility for any loss or damage, which may be suffered by any person in relation to their access and use of these third party links and websites.
  41. Sun Hung Kai Properties, the participating SHKP malls and merchants/suppliers have the right to terminate or suspend any access to the Web Site, for any reason, including, without limitation, if Sun Hung Kai Properties, the participating SHKP malls and merchants/suppliers, in its sole discretion, considers the use to be unacceptable, or in the event of any breach of the Terms. the Sun Hung Kai Properties, the participating SHKP malls and merchants/suppliers may, but shall be under no obligation to, provide a warning prior to termination of the use of the Web Site. 
  42. The Web Site and participating SHKP malls may amend these Terms at any time in its sole discretion. The amended Terms shall be effective immediately upon posting and users/ customers agree to the new Terms by continued use of the Web Site. 
  43. If any provision of these Terms of Use is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Use, which shall remain in full force and effect. No waiver of any provision in these Terms of Use shall be deemed a further or continuing waiver of such provision or any other provision.
  44. Sun Hung Kai Properties, participating SHKP malls and the Merchants/Suppliers reserve the right and revision on above terms without prior notice. Sun Hung Kai Properties, participating SHKP malls and the Merchants/Suppliers reserve the right of final decision in any dispute.

Purchase of Merchants’ Vouchers

  1. Merchants’ vouchers (the Vouchers) will be available for purchase from 12nn till 11:59pm from 31 July 2020 till 21 August 2020 (both days are inclusive). Subject to the time in the system of www.happybuymall.com.
  2. Vouchers and merchant list and quantity will be updated from time to time, and not be updated at the same time at 12nn daily and in no particular order, which users/ customers shall raise no objection. Sun Hung Kai Properties, the participating malls and merchants/suppliers will not bear any responsibility in any case of variation of time in different operation systems, network problems, system malfunctioning, poor phone reception or blocking by third party applications that cause the delay, loss, mistake or corruption of an information transfer.
  3. Limited quota applies on all Vouchers, while stock lasts. Sales of Vouchers will be ceased on day once all respective Vouchers are out of stock before 12:00 mindnight, no further notice or compensation shall be made.
  4. No vouchers will be reserved upon clicking the “add” or “confirm” button. Limited quota applies on voucher supply, first paid first served, while stock lasts.
  5. All purchase and transaction of Voucher(s) in this web site is not eligible for the HK$20 discount of “SHKP Malls Online Ordering Offer”, bonus point registration of The Point by SHKP or any promotion activities of malls (including gift and free parking order redemption)
  6. Vouchers are only applicable at outlet at designated mall stated on the printed Vouchers.
  7. Each customer entitles to purchase a maximum of 2 vouchers for the same merchant.
  8. The vouches are in print, customers should collect the printed voucher at designated pick-up location during operation hours on or before 30 September 2020. No replacement or refund shall be made if failed to collect on or before the specified deadlines.
  9. An unique code is assigned for each Voucher and shall be used once only. Repeat usage of same code will not be accepted. Each Voucher can only be used once.
  10. Each voucher can only be used once. A maximum of 10 vouchers can be used in each transaction. Voucher will be collected by shop staff upon usage.
  11. Vouchers must be presented before payment. No retrospective arrangement can be made.
  12. The face value of this voucher will be applied upon usage. The outstanding amount after deduction of this voucher value must be settled. If the value as indicated on this voucher exceeds the payment amount for which it is tendered, the unused portion of this voucher shall be forfeited and non-refundable in cash.
  13. Vouchers cannot be used for purchase of coupons, vouchers, gift cards or value adding.
  14. Vouchers are non-refundable, non-transferrable, not for sale, non-exchangeable for cash, cash coupon, gift certificate, coupon, products or services.
  15. All transactions with use of the Voucher will not be refunded, exchange for coupons, vouchers or certificates and no change will be given.
  16. The transaction amount with the use of Vouchers are not eligible to participate in any promotion, rewards, redemption or activities, including registration of bonus point of The Point by SHKP.
  17. Users/ customers should present the original printed Vouchers upon usage. Voucher is only valid with specified stamp. Photocopies, amended and damaged Vouchers will not be accepted.
  18. No replacement, exchange or compensation shall be made for loss, stolen or damage of Vouchers.
  19. Voucher will be expired after the merchant's business hour on 30 September 2020. No refund shall be made. The business hour of respective merchant varies, please check with the respective merchant for updates.
  20. Voucher usage is subject to terms and conditions, please refer to the Voucher or merchant for details.

Food & Beverage Ordering

  1. All food and beverage ordering is for takeaway pick-up only, delivery is not included and not applicable to dine-in.
  2. Merchants/Suppliers (as the case may be) reasonably endeavour to comply with the special instructions for an Order. However, in some cases where this is not feasible, possible or commercially reasonable, the Merchants/Suppliers reserve the right to proceed to prepare the Order in accordance with standard operating procedures. Neither the Web Site nor the Merchants/Suppliers shall be responsible to replace or refund an Order that does not conform to special instructions provided.  
  3. The Web Site, the participating malls, merchants/suppliers are not obligated to provide ingredient information or allergen information on the Web Site and do not guarantee that the Goods sold by Merchants/Suppliers are free of allergens. Please contact the Merchants/Suppliers before placing an Order on our Web Site for any allergic reactions or dietary restrictions and requirements.
  4. Users/ Customers have the right to a refund for a cancelled Order only if the Merchant/Supplier has not yet accepted the Order. Should users/ customers still decide to cancel the Order after it has been accepted by the merchant/ supplier, you understand that no refunds (whether in whole or in part) will be issued and no Goods in the cancelled Order will be tendered to the users / customers. 
  5. When Order placed, email notification will indicate the time for Pick-Up the Order (“Pick-up Time”). The Merchants/Suppliers will prepare the Order by the Pick-up Time. In some cases, a reasonable delay may be expected. The Pick-up Time is not guaranteed by either the participating malls or the Merchants/Suppliers.
  6. Users/ Customers must arrive at the pick-up location to collect your Goods according to the Pick-up Time. The Merchants/Suppliers agrees to hold the Order at the Merchants/Supplier’s premises for no more than a reasonable period of twenty (20) minutes from the Pick-up Time (“Holding Time”) and shall not be obliged to provide the Order if users/ customers fail to Pick-Up the Order within the Holding Time. Users/ Customers will still be charged for the Goods in the event fail to pick-up Goods from the Merchants/Suppliers, which no refund, exchange of Goods or any other form of products or services shall be made.
  7. In the event of unreasonable delays in Pick-Up attributable to users/ customers, users/ customers bear the risk of any damage or loss of Goods or any deterioration in quality or change in condition of the Goods (e.g. changes in the temperature fit for consumption). In this case, no replacement, refund or replacement of the Goods shall be made.
